Bill Summary

AN ACT to amend the executive law, in relation to requiring state and local law enforcement officers to identify themselves to the public

AI Summary

This bill requires state and local law enforcement officers to provide more transparency during various law enforcement activities by mandating specific identification and communication protocols. Under the proposed law, officers must identify themselves by providing their full name, rank, and command at the start of any law enforcement activity, which is broadly defined to include interactions such as pedestrian stops, frisks, searches, traffic stops, and noncustodial questioning. Officers must also explain the specific reason for their interaction with an individual. In situations that do not result in an arrest or summons, the officer must provide the subject with a business card containing their contact information, allowing the individual to submit comments or complaints about the encounter. The bill includes an important exception that allows officers to withhold identification if doing so would compromise public safety or an ongoing investigation. The legislative intent behind this bill is to build trust between law enforcement and the public by increasing transparency and addressing potential mistrust stemming from perceived discriminatory practices, while still recognizing the important work of police officers.
