This bill, known as the "one bad apple police bad behavior prevention law," amends the civil service law to establish new procedures for handling police officers accused of serious misconduct. When video or other evidence shows a police or peace officer engaging in egregious behaviors such as police brutality, racial profiling, evidence fabrication, unwarranted search and seizure, or abuse of authority, the police commissioner or authorized department leadership must immediately remove the officer's weapon and badge and reassign them to desk duty. The department is then required to conduct a prompt preliminary investigation to determine whether formal charges of incompetency or misconduct should be brought. If charges are warranted, the officer will remain on desk duty without their weapon and badge until a full investigation and hearing can be completed. If the preliminary investigation finds no basis for charges, the officer may be restored to full status and have their weapon and badge returned. The law applies to both current and future cases and takes effect immediately, providing a structured approach to addressing potential police misconduct while ensuring due process.
