AI Summary

This bill proposes significant changes to Pennsylvania's Labor Relations Act, focusing on expanding worker protections and labor organization rights. The bill redefines "employee" to exclude independent contractors, clarifies their definition, and requires employers to post notices about employee rights both physically and electronically. It introduces new unfair labor practice provisions that prohibit employers from coercing employees into not pursuing joint claims, requiring mandatory campaign meetings, or retaliating against employees who exercise their labor rights. The bill also establishes a more robust process for union representation elections, including provisions for certifying labor organizations even if an initial election fails due to employer interference. For initial collective bargaining agreements, the bill mandates good-faith negotiation and creates a mediation and arbitration process if parties cannot reach an agreement. Additionally, the bill strengthens penalties for labor law violations, allowing for significant financial penalties against employers who commit unfair labor practices, with potential personal liability for directors and officers. The penalties can include back pay, front pay, consequential damages, and liquidated damages, with amounts potentially reaching up to $100,000 for repeated violations. The bill aims to provide more comprehensive protections for workers seeking to organize and bargain collectively, giving the Pennsylvania Labor Relations Board more tools to enforce labor rights.
