This bill establishes the North Carolina Paid Family Leave Insurance Act, creating a comprehensive state-run insurance program that will provide paid leave benefits to eligible workers starting January 1, 2027. The program allows covered individuals to receive partial wage replacement for up to 12-18 weeks (depending on the type of leave) when they need to care for a new child, care for a family member with a serious health condition, address their own serious health condition, care for a covered service member, or handle qualifying exigencies related to military service. Employees and employers will contribute to the program through payroll contributions, with benefits calculated as a percentage of the worker's average weekly wage, ranging from 50-90% of earnings with a maximum benefit equal to the statewide average weekly wage. The bill includes strong employment protections, ensuring that workers can return to their job or an equivalent position after taking leave, and prohibits employers from retaliating against employees who use the program. Self-employed individuals can also opt into the program. The Division of Employment Security will administer the program, collect contributions, process claims, and conduct public education efforts to inform workers about the new benefit.
