This bill establishes new requirements for scrap metal businesses when receiving or purchasing scrap metals that may contain lithium-ion or propulsion batteries. The bill defines lithium-ion batteries as rechargeable batteries that work by moving lithium ions between electrodes, and propulsion batteries as those that could potentially pose an environmental risk, as determined by the Department of Environmental Protection. Scrap metal businesses must now require sellers to disclose in writing whether the scrap metal contains these types of batteries, and if the seller indicates no battery is present, the business must physically inspect the scrap metal to confirm. The businesses must maintain detailed records of these disclosures and inspections for at least five years, in addition to their existing record-keeping requirements for scrap metal transactions over $50 or 100 pounds. These requirements are designed to improve tracking and safety when handling potentially hazardous battery-containing materials, and to help prevent theft and unauthorized sales of scrap metal. The bill will take effect six months after enactment, allowing businesses time to prepare for the new regulations, and enables administrative agencies to begin preparing for implementation immediately.
