This bill modifies North Carolina General Statute 101-8 to expand the name change options for widows and widowers after the death of a spouse. Currently, widows and widowers can resume their pre-marriage surname, but the proposed legislation adds more flexibility by allowing them to: (1) use their pre-marriage surname, (2) hyphenate their pre-marriage surname with their last spouse's surname, or (3) take the surname of a previously deceased or divorced spouse. For name changes involving a previously divorced spouse who is still living, the bill requires an additional consent affidavit from that ex-spouse. To implement this name change, a widow or widower must apply to the county clerk of court, provide their last spouse's full name, include a copy of the spouse's death certificate, and sign the application using their full name. The clerks will record and index these name change applications as directed by the Administrative Office of the Courts. The bill would become effective immediately upon becoming law.
