This bill modifies the rights of professional land surveyors to enter private property for surveying purposes. The bill recodifies an existing law and provides clear definitions for key terms, including "critical infrastructure," "critical infrastructure facilities," "landowner," and "professional land surveyor." Professional land surveyors are now explicitly granted the right to enter lands of others when necessary to perform surveys, such as locating property corners, boundary lines, rights-of-way, and easements, while bringing their equipment and vehicles. The bill requires surveyors to notify landowners when practicable and clarifies that such entry does not constitute trespass. The law prohibits surveyors from destroying or damaging property without written permission and removes their ability to sue landowners for personal injury or property damage, except in cases of willful or deliberate harm. Additionally, the bill specifically restricts surveyors from entering lands traversed by operating railroads or containing critical infrastructure facilities. The bill also amends the professional engineering and land surveying regulations to explicitly state that a professional land surveyor's right of entry is a limited personal right based on their licensure. The changes become effective immediately upon becoming law.
