This bill directs the New York State Department of Environmental Conservation to create regulations for a state-owned property remediation program that allows state agencies to clean up contaminated properties. The program will cover properties owned by the state that have been affected by specific types of structural contamination, including stored materials, electrical equipment, asbestos, lead, polychlorinated biphenyls, and other defined contaminants. To be eligible, applicants must own state-owned real property (including recently disposed properties) and conduct remediation that meets existing environmental standards. The cleanup must be comprehensive enough to allow the property to be used for any purpose without long-term restrictions. Upon successful remediation and filing of necessary environmental easements, property owners can receive a certificate of completion and become eligible for tax credits. The bill will take effect 120 days after becoming law, with preliminary regulatory preparations allowed to begin immediately.
