This bill modifies the provisions for accreditation of environmental laboratories in Minnesota, specifically focusing on exemptions from national standards for quality control and personnel requirements. The bill removes the previous effective date of January 1, 2012, from two subdivisions of section 144.98, allowing laboratories analyzing samples for permit compliance to request exemptions from certain national standard requirements. Laboratories can be granted an exemption if they comply with the Standard Methods for the Examination of Water and Wastewater and provide personnel meeting specific requirements. The bill also outlines a detailed proficiency testing process, requiring laboratories to obtain acceptable test results from two annual proficiency studies. If a laboratory fails its first proficiency study, it must analyze a supplemental test sample and participate in the second study. Laboratories that fail two consecutive proficiency samples or do not submit results will have their accreditation revoked for the affected testing fields. Additionally, the commissioner retains the authority to require additional proficiency testing and collect costs associated with administering these provisions.
