AN ACT IN THE COUNCIL OF THE DISTRICT OF COLUMBIA To amend, on an temporary basis, the Universal Paid Leave Amendment Act of 2016 to prohibit private disability insurance providers from reducing short-term disability benefits based on actual or estimated paid leave benefits to which an eligible individual may be entitled to from the District, regardless of the jurisdiction in which the insurance policy was issued or written; and to amend the Insurance Trade and Economic Development Amendment Act of 2000 to make the prohibition on offsetting or reducing benefits under a private market short-term disability insurance policy based on estimated or actual benefits received under the Universal Paid Leave Amendment Act of 2016 enforceable under that law, regardless of the jurisdiction in which the insurance policy was issued or written.
AI Summary
This bill amends two existing District of Columbia laws to strengthen protections for workers receiving short-term disability insurance by prohibiting insurance providers from reducing disability benefits based on actual or estimated paid leave benefits from the District's Universal Paid Leave Amendment Act. Specifically, the bill prevents insurers from offsetting or reducing temporary or short-term disability insurance benefits for an eligible individual, regardless of where the insurance policy was issued, written, or delivered. The bill clarifies definitions of "eligible individual" and "self-insured employer" by referencing the existing Universal Paid Leave Amendment Act, ensuring that workers cannot have their disability insurance benefits diminished by the separate paid leave benefits they may receive. The legislative change is temporary and will apply starting May 1, 2025, and will expire 225 days after taking effect. By preventing insurers from reducing disability benefits, the bill aims to provide more comprehensive financial support for workers during periods of short-term disability or leave.
