This bill prohibits registered sex offenders from residing within 1,350 feet (approximately a quarter mile) of schools, playgrounds, parks, or child daycare facilities. The legislation amends several existing laws to implement and enforce this residency restriction, which will remain in effect for as long as an individual is classified as a sex offender. The bill defines a "school" as any public or private elementary, parochial, intermediate, junior high, vocational, or high school regularly used for instructional purposes. To ensure compliance, the bill requires multiple government entities to notify sex offenders of these restrictions: the division managing sex offender registrations must inform offenders in initial and annual correspondence, parole officers must notify releasees orally and in writing, and courts must notify defendants in writing. Violations of these residency restrictions can result in criminal penalties, with first-time offenses classified as a class A misdemeanor and subsequent offenses classified as a class D felony. The law will take effect 60 days after becoming law and will apply to sex offenders convicted or released on or after that date.
