This bill establishes a new process for alternative licensing inspections for certain human services programs, specifically targeting qualified residential treatment programs, psychiatric residential treatment facilities, and certified community behavioral health clinics. The bill allows license holders with qualifying accreditations from recognized bodies like the Joint Commission or the Commission on Accreditation of Rehabilitation Facilities to request alternative licensing inspections. To be eligible, a license holder must have at least one previous comprehensive inspection, demonstrate substantial and consistent compliance (meaning no significant violations or maltreatment allegations in the past five years), and maintain accreditation standards. The commissioner will review the accrediting body's standards to determine if they are comparable to existing state licensing requirements. Under this alternative inspection process, the commissioner may still conduct periodic inspections, investigate complaints, and take action if serious compliance issues arise. The license holder must submit accreditation survey results to the commissioner, notify them of any loss of accreditation, and continue to comply with all existing licensing standards. The bill also preserves the commissioner's responsibility to investigate alleged maltreatment of minors and vulnerable adults, and provides a mechanism for terminating the alternative inspection status if the license holder fails to meet ongoing requirements.
