Bill Summary

AN ACT IN THE COUNCIL OF THE DISTRICT OF COLUMBIA To amend, on an emergency basis, due to congressional review, the Condominium Act of 1976 to authorize condominium unit owners’ associations to conduct virtual meetings and clarify voting and quorum requirements for such meetings; to amend section 29-910 of the District of Columbia Official Code to allow cooperatives to conduct remote meetings; and to amend sections 29-1005.06, 29-1005.07, and 29-1008.11(b) of the District of Columbia Official Code to allow limited equity cooperatives to conduct remote meetings.

AI Summary

This bill amends the Condominium Act of 1976 and various sections of the District of Columbia Official Code to provide more flexibility for condominium unit owners' associations and cooperatives to conduct virtual meetings. Specifically, the bill allows meetings of unit owners' associations, executive boards, and committees to be held via telephone conference, video conference, or similar electronic means, with the requirement that all participants can hear and comprehend each other. The bill mandates that electronic meeting access instructions be included in meeting notices and permits the executive board to authorize electronic voting up to 7 days before a scheduled meeting. For cooperatives, including limited equity cooperatives, the bill removes previous restrictions that required authorization in articles or bylaws for remote meetings, effectively making virtual meetings permissible by default. The legislation is designed as an emergency amendment, meaning it will remain in effect for up to 90 days, and is intended to provide more adaptable meeting options for community associations in the District of Columbia, likely in response to changing communication technologies and recent experiences with remote collaboration.
