This bill amends Delaware law to restrict law enforcement officials (including constables and police officers) from cooperating with federal agencies on civil immigration enforcement activities at sensitive locations without prior authorization from the Delaware Attorney General. Specifically, the restricted locations include child-serving entities, higher education institutions, places of worship, and health-care facilities, which are comprehensively defined to include a wide range of medical and care facilities such as hospitals, nursing homes, physician offices, independent laboratories, and various healthcare provider offices. To obtain authorization, the law enforcement agency's supervising authority must submit a written request at least 72 hours in advance, detailing the purpose, scope, duration, and specific individuals potentially impacted by the proposed immigration enforcement activity. The Attorney General must respond to the request within 48 hours, and if no response is provided, the request is automatically considered authorized. This legislation aims to provide additional protections for vulnerable populations by creating a formal review process for federal immigration enforcement actions in sensitive community spaces.
