Bill Summary
AN ACT IN THE COUNCIL OF THE DISTRICT OF COLUMBIA To amend, on a temporary basis, An Act To create a Department of Corrections in the District of Columbia and the Corrections Oversight Improvement Omnibus Amendment Act of 2022 to designate the Department of Corrections as the District agency to provide a free appropriate public education under the Individuals with Disabilities Education Act and District law to certain individuals in its custody and detained in its secure facilities.
AI Summary
This bill temporarily amends two existing laws to require the Department of Corrections in Washington, D.C. to provide a free appropriate public education (FAPE) to individuals with disabilities who are in its custody during the 2024-2025 school year. Specifically, the bill mandates that the Department of Corrections offer special education services to individuals with disabilities who are between 18 years old and the end of their FAPE eligibility under the Individuals with Disabilities Education Act (IDEA) and District law while they are detained in secure facilities. IDEA is a federal law that ensures students with disabilities receive specialized educational services tailored to their individual needs. The bill makes these changes on a temporary basis, with the provisions set to apply starting April 12, 2025, and expire after 225 days of taking effect. The primary goal is to ensure that young adults with disabilities who are in the custody of the Department of Corrections continue to receive appropriate educational support during their detention.
