This bill modifies the assessment and allocation of funds from railroad and pipeline companies for emergency preparedness activities. Specifically, it reduces the total annual assessment from railroad companies from $4,000,000 to $3,418,000 and introduces a separate $582,000 assessment for pipeline companies. The bill specifies how these funds will be distributed: $560,000 will go to the Pollution Control Agency for environmental protection activities related to railroad discharge preparedness, $1,500,000 will be deposited in the grade crossing safety account, and the remaining funds will be appropriated to the commissioner of public safety for various safety purposes. The bill also requires the commissioner of public safety to submit a detailed report by January 15, 2026, listing revenues and expenditures from the railroad and pipeline safety account for the previous two fiscal years. Additionally, if the account balance exceeds $2,000,000 at the end of a fiscal biennium, the excess amount will be transferred to the grade crossing safety account. The assessments for both railroad and pipeline companies will be divided proportionally based on route miles or gallons of hazardous substances transported, and companies involved in significant incidents can be assessed additional costs for postincident review and analysis.
