This bill amends the Arkansas Soil Nutrient Application and Poultry Litter Utilization Act to provide greater legal protections for farmers and landowners who have approved nutrient management plans (NMPs) and poultry litter management plans. The bill clarifies that designated nutrient application in nutrient surplus areas must follow time, place, and manner restrictions determined by the commission and included in management plans. Importantly, the bill stipulates that applying nutrients consistent with an approved plan cannot be the basis for civil or criminal liability for the plan holder, their agents, or principals. Additionally, the bill establishes that administrative violations of these management plans cannot lead to criminal or civil actions, and alleged violations cannot be grounds for private lawsuits. The only recourse for violations would be enforcement of plan terms and potential administrative fines. The bill also defines an "approved" management plan as one that has been approved by the relevant authority and has not been revoked, rescinded, or replaced by a more recent plan, providing clarity and protection for agricultural professionals managing soil nutrients and poultry litter.
