Bill Summary

AN ACT To amend and reenact R.S. 23:1393(A)(2), relative to workers' compensation insurance by the Louisiana Workers' Compensation Corporation to Louisiana employers with operations in other states; to provide for the total amount of premiums received in any calendar year from operations in other states; and to provide for related matters.

AI Summary

This bill modifies the Louisiana Workers' Compensation Corporation (LWCC) regulations by removing existing limitations on premium collections from operations in other states. Currently, LWCC was restricted from collecting more than 20% of its annual premiums from out-of-state operations, with no more than 30% of an individual insured's premium coming from out-of-state exposures. The proposed changes eliminate these percentage caps, allowing LWCC greater flexibility in providing workers' compensation insurance coverage for Louisiana-based businesses with operations in other states. The bill specifically applies to companies that are domiciled, incorporated, or have their principal place of business in Louisiana. LWCC can continue to offer various types of workers' compensation coverage, including state workers' compensation, Longshore and Harbor Worker's Compensation Act coverage, and Jones Act coverage. These changes will take effect on August 1, 2025, and are intended to provide more operational freedom for the state-created workers' compensation insurance corporation.
