This bill amends Louisiana Revised Statutes (R.S.) 22:1464(D) to clarify the process for handling confidential insurance rate filing information. Currently, rate filings and supporting documents submitted to the insurance commissioner are generally open to public inspection after a notification period, but the bill introduces a more structured approach to determining what information can be considered confidential. The bill stipulates that the commissioner, not the insurer, will determine whether submitted information qualifies as confidential, trade secret, or proprietary. If someone requests access to information marked as confidential, the commissioner must notify the insurer in writing and provide a determination about disclosure. The insurer then has ten days to request a hearing before the division of administrative law if they disagree with the commissioner's determination. During such a hearing, the commissioner's initial determination is stayed (paused). The bill also specifies that any legal proceedings related to these determinations should be tried quickly and preferentially, and courts may review documents privately (in camera) before making a decision. Importantly, the bill maintains that non-confidential parts of records remain available for public examination and reproduction.
