This bill modifies Minnesota's data practices law to provide broader access to unredacted portable recording system data (such as body camera footage) for individuals involved in collision investigations. Currently, when someone requests data from a portable recording system, other individuals in the recording must be redacted unless they are on-duty peace officers. The bill now allows people entitled to a collision report to receive unredacted copies of all portable recording system data related to the collision investigation. Law enforcement agencies can still deny such requests under three specific circumstances: if the data would interfere with an active investigation, if the data is offensive to common sensibilities, or if the data is classified as non-public under existing law. If an agency denies access based on an active investigation, they must provide a written explanation and inform the requestor that they can seek relief through the district court. The bill aims to increase transparency in collision investigations by making more comprehensive video evidence available to involved parties.
