This bill introduces two key provisions to protect consumer privacy related to geolocation data. First, it prohibits property and casualty insurance companies from increasing insurance rates based on GPS (Global Positioning System) information about a vehicle's usage, with some exceptions. Insurers cannot penalize drivers using GPS data, though they can offer discounts for GPS-equipped vehicles or use GPS to recover stolen vehicles. The only exception is if a consumer voluntarily installs a GPS device directly from the insurer for tracking driving habits. Second, the bill restricts motor vehicle manufacturers and dealers from collecting, selling, or sharing a consumer's GPS location and driving behavior data without explicit consent. Companies must obtain affirmative permission before collecting such data, provide consumers with the ability to opt-out, limit data collection, access their own data, and delete their information. The bill allows data sharing only with emergency first responders or law enforcement agencies. Violations can result in a $1,000 fine for each incident. The law will take effect 90 days after being signed.
