This bill allows an incorporated town or a city of the second class to petition the State Board of Education for establishing a local public elementary school or satellite school under specific conditions. The bill requires that the affected school district must have included a public elementary school, be within the boundaries of the town or city, have resulted from a school consolidation within the last 20 years, and the town or city must have adequate school facilities. To establish the school, parents or guardians must first file a written appeal with the receiving district's board of directors, and if approved, the school district and town/city will jointly file an appeal with the State Board of Education. If established, the new elementary school would be part of the receiving school district, and the town/city and school district may enter into an agreement for in-kind contributions to support the school's establishment and maintenance. This legislation appears designed to provide local communities that have undergone school consolidation with an opportunity to maintain a nearby elementary school for their children.
