This bill amends South Carolina zoning law by establishing new procedures for handling situations where zoning officials determine a property's current or intended use is not permitted under existing zoning classifications. Specifically, if a local governing body, planning commission, zoning administrator, or board of zoning appeals determines that a property's use violates zoning regulations, all previously issued permits for development or construction will become immediately invalid, regardless of when they were originally issued. Any ongoing development or construction must cease immediately and cannot resume until either the property is brought into compliance with zoning ordinances (which may require rezoning or obtaining a variance) or a court specifically authorizes construction to proceed. The suspension of permits and construction applies as soon as a zoning determination is made and remains in effect during any administrative or judicial appeals, unless a court specifically orders otherwise. The bill takes effect upon the Governor's approval and provides local zoning authorities with a clear mechanism to halt development that does not conform to established zoning regulations.
