This bill amends Delaware's law on Lethal Violence Protective Orders (LVPOs) by extending the maximum duration of these orders from 1 year to 5 years. The bill modifies two key sections of the Delaware Code: Section 7704 and Section 7705. Under the updated law, when a Superior Court finds clear and convincing evidence that a respondent poses an immediate danger of causing physical injury to themselves or others through firearm or weapon possession, the court can issue an LVPO for up to 5 years instead of the previous 1-year limit. The bill also adjusts the rules around requesting a hearing to terminate the order, now limiting respondents to one written request per year during the order's effective period. An LVPO can require a respondent to relinquish firearms, prohibit weapon possession, prevent residing with someone who owns weapons, and allow law enforcement to search for and seize weapons. The core purpose of these orders remains protecting individuals from potential self-harm or harm to others by temporarily restricting a person's access to firearms when they are deemed to be a significant risk.
