This bill amends the Aquifer Recharge Flexibility Act to expand and clarify the ways water rights holders can use existing rights-of-way, easements, permits, or other authorizations for aquifer recharge purposes. The bill allows water rights holders to transport and use water for aquifer recharge (a process of replenishing underground water sources) without requiring additional authorization from the Secretary, as long as they provide a 30-day notice to the Bureau of Land Management. The notice must include details about the intended use, the specific right-of-way or authorization being used, and an agreement between the water rights holder and the entity planning to use the water for recharge. The bill also provides that most uses of existing authorizations for aquifer recharge will be exempt from paying additional rent to the Bureau of Land Management, with an exception for for-profit uses and entities. Additionally, the bill clarifies that this amendment does not waive compliance with environmental laws such as the Federal Water Pollution Control Act, the Endangered Species Act, and the Wild and Scenic Rivers Act, nor does it provide authority to construct or expand existing infrastructure.
