This bill introduces the Intellectual Freedom Protection Act, which primarily regulates public postsecondary institutions in Minnesota, including those governed by the Minnesota State Colleges and Universities Board. The bill prohibits institutions from conditioning admission, benefits, hiring, or promotion on an applicant's or faculty member's pledge of allegiance to or statement supporting or opposing any political ideology, including diversity, equity, inclusion, or patriotism. Institutions cannot grant or deny opportunities based on viewpoints expressed in such pledges or statements. The bill does not restrict academic freedom or prevent compliance with antidiscrimination laws, and institutions can still consider candidates' academic qualifications. Public postsecondary institutions must publicly post all training materials and policies related to nondiscrimination, diversity, equity, and inclusion on their websites. The bill creates a private right of action, allowing individuals whose rights have been violated to sue in state or federal court within one year, potentially receiving declaratory relief, damages, court costs, and attorney fees. Additionally, the attorney general can file suits against institutions, with potential civil penalties of $100,000 per violation. Institutions found in violation may also take disciplinary action against responsible employees.
