This bill: 1. Requires that the Governor, in performing the Governor's duties related to emergency management functions and emergency powers, consult directly with the Legislative Council; 2. Requires the Governor to narrowly tailor actions to address the public health or safety emergency; 3. Requires the Governor, during a state of emergency, to provide a detailed written weekly briefing to the Legislative Council detailing actions taken to address the emergency; and 6. Provides that, as long as each House of the Legislature is able to assemble, a state of emergency may not continue for longer than 30 days unless it is renewed by a 3/5 vote of each House.

AI Summary

This bill enhances legislative oversight of the Governor's emergency powers by introducing several key provisions. The bill requires the Governor to consult directly with the Legislative Council when performing emergency management functions and mandates that any emergency actions be narrowly tailored to address specific public health or safety concerns. It establishes that the Superior Court has jurisdiction to review the Governor's emergency actions and can issue temporary restraining orders or injunctions, with any appeals to the Supreme Judicial Court being expedited. The bill prohibits the Governor from reissuing or renewing substantially similar emergency proclamations without legislative approval and requires weekly detailed written briefings to the Legislative Council about emergency actions. Furthermore, the bill stipulates that a state of emergency cannot continue for more than 30 days unless renewed by a three-fifths vote in each House of the Legislature, and the Legislature can terminate a state of emergency at any time by a majority vote. These provisions aim to create a more balanced approach to emergency governance by increasing legislative input and preventing potential executive overreach during times of crisis.
