This bill establishes a new process for addressing the surplus funds of nonprofit health insurance carriers in Washington state, aiming to improve health insurance affordability. Specifically, by October 1, 2026, the state's insurance commissioner will determine if a nonprofit health carrier's surplus, defined as an amount 100 times the minimum net worth required by state law (RCW 48.44.037(1)(a)), is excessive. If deemed excessive, the carrier must pay 10% of that excessive surplus to the state's health care affordability account, which funds a premium assistance program. However, a nonprofit carrier can request a hearing to argue for a reduced payment if they can prove that paying the full amount would financially impair their operations. The commissioner has the authority to adopt rules to implement these provisions.
