This bill establishes a new criminal offense called "illegal remunerations" that targets inappropriate financial exchanges in two primary contexts: healthcare program referrals and grant processes. The bill creates detailed legal provisions that criminalize soliciting, receiving, offering, or providing money, services, or other valuable considerations in exchange for referrals, recommendations, or actions related to federal health care programs, behavioral health programs, and government grants. Specifically, the law makes it illegal to receive or offer anything of value in exchange for referring patients, purchasing services, or applying for healthcare services under specific programs. Similarly, for grants, it criminalizes receiving or offering value in exchange for awarding grants, recommending grants, or providing false information about grants. The penalties vary based on the value of the remuneration: if the value exceeds $5,000, offenders can face up to ten years in prison and/or a $20,000 fine; if the value is $5,000 or less, offenders can face up to five years in prison and/or a $10,000 fine. The bill also includes provisions for aggregating multiple offenses within a six-month period and specifies that the law will take effect on August 1, 2025, applying to crimes committed on or after that date.
