This bill establishes a moratorium and comprehensive study on surface water transfers in North Carolina, with the goal of updating decades-old water transfer regulations. The North Carolina Collaboratory at UNC-Chapel Hill will conduct an in-depth review of the current surface water transfer approval process, examining environmental impact studies, economic equity considerations, climate trends, and water resource management strategies. The study will involve consulting with the Army Corps of Engineers and other water management entities to assess the impacts of significant water transfers. During the moratorium, which runs until March 1, 2027, the Environmental Management Commission (EMC) cannot issue certificates for new surface water transfers or significant increases to existing transfers that would exceed 15 million gallons per day between river basins. The Collaboratory is required to report its findings and proposed legislation to the 2027 General Assembly, with the aim of developing more comprehensive and equitable regulations that account for economic, environmental, and infrastructure challenges related to water resource management.
