Bill Summary

This bill prohibits the force feeding of duck, goose, or other poultry, for the production of foie gras. The prohibition would not apply, however, when a person forcibly feeds a bird for the purpose of improving the bird's health. This bill also prohibits the distribution, sale, and offer for sale of foie gras and any foie gras products unless the foie gras or foie gras containing product originated from a state or jurisdiction that bans the practice of force feeding birds. Furthermore, the bill authorizes civil penalties to be imposed by the Secretary of Agriculture for a violation of the bill. The Superior Court and municipal court would have jurisdiction over proceedings for the enforcement of penalties under the bill. A person who violates the provisions in the bill would receive a written warning for the first offense, and a fine of $100 for a second and each subsequent offense. Each day a violation continues would constitute a separate offense. This bill would take effect on the 60th day after the date of enactment.

AI Summary

This bill prohibits the forcible feeding of geese, ducks, or other poultry for the production of foie gras, which involves using a tube or apparatus inserted into the bird's beak or throat to overfeed it and enlarge its liver. The bill specifically allows force-feeding only when done to improve the bird's health. It also bans the distribution, sale, or offering for sale of foie gras or foie gras products unless they originate from a jurisdiction that already prohibits force-feeding birds. Violations will result in a written warning for the first offense and a civil penalty of up to $100 for subsequent offenses, with each day of continued violation considered a separate offense. The Secretary of Agriculture will collect these penalties through civil action, and both Superior and municipal courts will have jurisdiction to enforce the penalties. The bill will go into effect 60 days after its enactment, effectively creating a comprehensive restriction on the production and sale of foie gras in the state by targeting both the production method and the commercial sale of the product.
