This bill proposes to amend the North Carolina Constitution by adding a new section that establishes a constitutional right to clean water, clean air, and a preserved environment for all people in the state. The proposed amendment would require the State of North Carolina, including all its branches, agencies, and political subdivisions, to act as a trustee of the state's natural resources, which include air, waters, coastal lands, wetlands, open lands, native flora and fauna, and soils. The amendment mandates that these resources must be conserved, protected, and maintained for the benefit of both current and future generations. Importantly, the proposed rights are declared to be "inalienable and self-executing," which means they would be fundamental and directly enforceable. The bill stipulates that this constitutional amendment will be placed on the ballot during the November 2026 statewide general election, with voters able to choose "FOR" or "AGAINST" the amendment. If a majority of voters support the amendment, the Bipartisan State Board of Elections and Ethics Enforcement will certify it, and the Secretary of State will enroll it as a permanent record, making it effective upon certification.
