Bill Summary

AN ACT TO ESTABLISH A PILOT PROGRAM TO IMPROVE PUBLIC SAFETY BY AUTHORIZING THE USE OF ELECTRONIC SPEED-MEASURING SYSTEMS BY THE DEPARTMENT OF TRANSPORTATION TO DETECT SPEED LIMIT VIOLATIONS IN HIGHWAY WORK ZONES; TO ESTABLISH STANDARDS FOR THE APPROVAL, USE, AND CALIBRATION OF ELECTRONIC SPEED-MEASURING SYSTEMS; TO ESTABLISH A CIVIL PENALTY FOR SPEED VIOLATIONS IN HIGHWAY WORK ZONES THAT ARE DETECTED BY THOSE SYSTEMS; TO CREATE A NEW SPECIAL FUND WITHIN THE STATE CIVIL PENALTY AND FORFEITURE FUND; AND TO PROVIDE FOR THE PAYMENT OF THE PENALTIES INTO THE DESIGNATED SPECIAL FUND.

AI Summary

This bill establishes a pilot program for electronic speed-measuring systems (automated traffic cameras) in highway work zones to improve public safety, with specific provisions for implementation and enforcement. The Department of Transportation is authorized to use these systems in up to 25 work zones on State-maintained highways, with mandatory warning signs placed near the cameras. When a vehicle is detected speeding, a $250 civil penalty will be issued to the registered vehicle owner, who can contest the violation through an administrative hearing process. The electronic systems must capture clear digital photographs showing the vehicle's registration, speed, date, time, and location of the violation. Importantly, these speed camera violations will not result in points on the driver's license or insurance record. Seventy-five percent of the collected penalties will be directed to a new Civil Penalty Litigation Fund, which will allocate money to local school administrative units on a per-pupil basis, while the remaining 25% will go to the State Public School Fund. The pilot program will run from October 1, 2025, to October 1, 2030, with the Secretary of Transportation required to submit annual reports detailing the program's operations, violations, and financial outcomes to legislative oversight committees.
