Bill Summary

This bill removes the requirement under current law that non-physical, electronic records of online sales of motor vehicles be kept and maintained in a format that allows for immediate inspection and examination. Under the bill, a person who is licensed to buy, sell, lease, or deal in motor vehicles is required to keep non-physical, electronic records of online sales of motor vehicles in a format that allows for inspection and examination by the Chief Administrator (chief administrator) of the New Jersey Motor Vehicle Commission, or the chief administrator's agent. In addition, the bill requires the chief administrator, or a designee, to provide one business day advanced written notice to an individual or entity engaged in the business of buying, selling, or dealing in motor vehicles; a licensed motor vehicle dealer; or a licensed leasing dealer prior to entering the building of an individual or entity engaged in the businesses listed above for the purpose of examining books and records.

AI Summary

This bill makes two key changes to the regulations governing motor vehicle sales in New Jersey. First, it modifies the requirement for electronic record-keeping by motor vehicle dealers, removing the word "immediate" from the requirement that electronic records of online sales be available for inspection by the Chief Administrator of the New Jersey Motor Vehicle Commission. This means dealers now must maintain electronic records in a format that allows for inspection, but not necessarily with instant access. Second, the bill changes the advance notice requirement for record inspections from 72 hours to one business day, mandating that the Chief Administrator or a designee provide written notice to a motor vehicle dealer or business before entering their premises to examine books and records. These changes aim to provide more flexibility for motor vehicle dealers in record-keeping and provide a more precise timeline for administrative inspections, while maintaining oversight of online vehicle sales in the state.
