This bill amends existing Maine law to expand consumer protections related to automatic subscription and health club membership renewals. It broadens the definition of "automatic subscription renewal" to include health club memberships alongside existing categories like online magazines, mobile apps, and internet services. The bill requires sellers to provide clear, conspicuous disclosures about renewal terms, including pricing, charges, and cancellation procedures. Sellers must now obtain express consumer consent for automatic renewals and allow cancellation through the same method used to initially sign up. For extended subscriptions or memberships (12 months or more), sellers must provide notice 30 days before renewal, explaining that the subscription will automatically renew unless canceled. The bill defines "health club" broadly, covering fitness centers and exercise facilities, with some specific exemptions like nonprofit and government-operated establishments. Violations are considered breaches of the Maine Unfair Trade Practices Act, and sellers found to have made unauthorized charges may be required to refund or credit consumers three times the unauthorized amount. The Attorney General is empowered to enforce these provisions, and the law will apply to offers and agreements entered into or renewed on or after January 1, 2026.
