Bill Summary
AN ACT to amend the public service law, in relation to directing the public service commission to review cellular services within the state
AI Summary
This bill, known as the "cellular mapping act," mandates that the Public Service Commission (PSC) conduct a comprehensive review of cellular services across New York State. The PSC will define and assess cellular service based on categories like "served for calling" (at least two providers or one with over 90% call completion), "underserved" (fewer than two providers or 30-90% call completion), and "unserved" (no providers or less than 30% call completion), as well as download speed categories: "excellent" (at least 25 megabits per second or mbps), "adequate" (5-25 mbps), "poor" (under 5 mbps), and "no cellular coverage" (over 50% of speed tests fail). The commission is required to study the availability, affordability, and reliability of these services, considering federal data, competition levels, and barriers to excellent coverage, while also identifying solutions for underserved areas and examining negative social and economic impacts caused by poor service, such as increased business costs or lack of emergency communication. A detailed map of cellular service access by location will be created and published, including call completion rates, speeds, provider numbers, and prices, with a mechanism for consumers to challenge test results. The PSC will report its findings and recommendations annually to state leadership and hold at least four regional public hearings to gather input from various stakeholders, including providers, public safety organizations, and businesses, and will also assess the workforce needed for statewide excellent coverage and work with providers to prioritize service expansion to communities most affected by current deficiencies.
