Bill Summary

AN ACT to amend the vehicle and traffic law, in relation to the use of photo speed violation monitoring systems for the purposes of enforcement of license plate obstruction, concealment, and/or distortion violations in the city of New York; to amend chapter 189 of the laws of 2013, amending the vehicle and traffic law and the public officers law relating to establishing in a city with a population of one million or more a demonstration program implementing speed violation monitoring systems in school speed zones by means of photo devices, in relation to making technical corrections and extending such provisions related thereto; and to repeal certain provisions of the vehicle and traffic law relating thereto

AI Summary

This bill permits the use of photo speed violation monitoring systems in New York City to enforce license plate obstruction, concealment, and distortion violations, and extends the existing provisions for speed cameras in school zones. Specifically, the bill modifies existing traffic law to allow photo speed monitoring systems to capture and report instances where license plates are deliberately obscured or altered, which previously could not be used as evidence. The bill requires the city to issue notices of liability for such violations and includes provisions for how these violations will be processed through the parking violations bureau. It also extends the demonstration program for school zone speed cameras until July 1, 2030, and requires detailed annual reporting on the program's effectiveness, including the number of violations, types of incidents, and revenue generated. The bill ensures that the images captured by these systems are used only for the specific purpose of enforcing traffic violations and have strict privacy protections. Importantly, the bill maintains that these violations are not considered criminal convictions and will not affect a driver's insurance or driving record, treating them as administrative infractions.
