Bill Summary
AN ACT to amend the real property actions and proceedings law, in relation to adjournments relating to right to counsel
AI Summary
This bill amends the Real Property Actions and Proceedings Law to provide additional protections for parties in legal proceedings who are seeking free legal counsel. Specifically, in jurisdictions where a party may be eligible for free legal representation, the court is now required to notify the party about their ability to obtain such counsel. If the party chooses to seek free legal representation, the court must adjourn the trial for at least 30 days to allow the party time to retain and consult with counsel. The bill further stipulates that the court shall grant additional 30-day adjournments as necessary for the party to secure legal representation. This change aims to ensure that parties who are unable to afford legal representation have a fair opportunity to obtain counsel before their trial proceeds. The bill also modifies provisions related to adjournments in summary proceedings, clarifying that certain adjournments sought by unrepresented respondents for the purpose of securing counsel will not count against the total number of adjournments. The legislation takes effect immediately and applies to pending actions and proceedings.
