This bill amends the Michigan Revised Judicature Act to modify notice requirements for claims filed in the Court of Claims. Currently, claimants must file a written claim or notice of intention to file a claim within one year of the claim's accrual, providing detailed information such as the time and place of the claim, nature of the claim, damages sustained, and the specific state agency involved. The bill creates two new exceptions to these notice requirements: claims for compensation under the Wrongful Imprisonment Compensation Act and claims to which section 5851b of the Revised Judicature Act applies. For property damage or personal injury claims, the existing requirement remains that claimants must file within 6 months after the event giving rise to the claim. The bill will apply retroactively to pending actions and those brought under section 5851b(4). Importantly, the bill is tied to another piece of legislation (Senate Bill No. 257) and will only take effect if that bill is also enacted into law, creating a legislative interdependence between the two measures.
