This bill amends Michigan's penal code to decriminalize certain utility service restoration actions under specific circumstances. The legislation modifies how individuals are penalized for tampering with utility services, particularly focusing on water service shutoffs. Under the new provisions, if a person restores water service to their lawfully occupied residence after a shutoff due to inability to pay, and does not damage metering or backflow prevention devices, they would be subject to graduated civil infractions rather than criminal charges. For a first offense, the person may be ordered to perform up to 25 hours of community service; a second offense could result in a fine up to $250 or 50 hours of community service, and a third or subsequent offense could lead to a fine up to $500 or 100 hours of community service. Importantly, the bill mandates that individuals issued a citation for such an infraction must be referred to a water assistance or affordability program if they are eligible. The changes aim to provide more lenient treatment for individuals struggling with water service payments while still maintaining protections for utility infrastructure. The bill will take effect 90 days after being enacted into law.
