This bill enacts the Safer Consumption Services Act, which establishes a framework for creating overdose prevention centers (also known as safe injection sites) in New York State. The bill allows the state health department to approve community-based organizations and medical facilities to operate these centers, which would provide a hygienic space for individuals to consume pre-obtained drugs under supervised medical conditions. The centers must offer comprehensive services including sterile injection supplies, first aid monitoring, overdose prevention education, referrals to substance use disorder treatment, sexual health resources, naloxone access, and confidential participant tracking. The bill provides legal immunity for program participants, staff members, administrators, and property owners from criminal prosecution, civil penalties, or professional disciplinary actions when operating or participating in these programs in good faith. Entities must submit annual reports to the health department detailing participant numbers, characteristics, needle distribution, overdose interventions, and service referrals. The primary goal of these centers is to reduce harm and provide supportive services to individuals struggling with substance use, with an emphasis on safety, education, and connection to additional resources.
