This bill establishes two new criminal offenses related to "spoofing" police agency telephone numbers. Spoofing is the practice of deliberately falsifying the caller ID information to make it appear that the call is coming from a different number, in this case, a police agency's number. The first offense, spoofing a police agency telephone number in the second degree, occurs when someone intentionally places a call that displays a police agency's phone number or information, with the intent to defraud, harass, annoy, threaten, or alarm another person. This is classified as a class A misdemeanor. The second offense, spoofing a police agency telephone number in the first degree, applies when a person commits the second-degree offense and has a prior conviction for the same or similar offense within the past ten years. This is classified as a class E felony. The bill aims to protect individuals from fraudulent or harassing phone calls that falsely appear to come from law enforcement agencies, with increasingly severe penalties for repeat offenders. The law will take effect 60 days after becoming official.
