This bill amends the New York education law to establish a specific procedure for disciplinary actions against bus drivers and bus drivers' assistants in school districts located in Westchester, Putnam, Nassau, and Suffolk counties. Under the new provisions, school districts must first adhere to the terms of any collectively bargained agreement governing disciplinary actions for bus drivers and assistants. However, if a superintendent certifies that a driver or assistant committed egregious misconduct that created a clear and present danger to children's safety, the district can bypass standard grievance procedures. In such cases, an expedited fact-finding process must be completed within five business days. If a driver or assistant experiences a wage reduction during this process and is subsequently found to be improperly accused or exonerated, they will be entitled to punitive damages. This bill aims to balance the need for swift disciplinary action with protecting the rights of bus transportation employees by establishing a clear, time-limited process for addressing serious misconduct allegations.
