This bill amends the Michigan Condominium Act to modify provisions related to undeveloped land in condominium projects. The bill clarifies that changes in a condominium project must be reflected in amended documents, and if those changes involve unit boundary modifications or additions/eliminations of units, a replat of the condominium subdivision plan must be prepared and recorded. For a period of 10 years after the master deed is recorded, developers retain the right to withdraw undeveloped land or convert undeveloped condominium units to "must be built" units without needing consent from co-owners or other interested parties. If the developer does not exercise these rights within the specified timeframe, the association of co-owners can vote to declare the undeveloped land as reverting to general common elements, effectively ending the developer's rights to construct units on that land. The bill also provides a specific definition of "undeveloped land" as land with recorded condominium units where no construction has commenced and no units are identified as "must be built". These provisions aim to provide clarity and flexibility in the development and management of condominium projects while protecting the interests of both developers and co-owners.
