Bill Summary

AN ACT to amend the environmental conservation law, in relation to establishing whale strike prevention policies for large vessels

AI Summary

This bill, known as the "whale strike prevention act," requires owners of commercial vessels that are 500 feet or longer to establish and maintain whale interaction prevention policies. A "commercial vessel" is defined as any mechanically powered vessel used for commercial purposes in the marine and coastal district, and a "whale interaction" is defined as an act that constitutes harassment under federal law (16 U.S.C. 1362). These policies must consider federal and international best practices, the latest scientific understanding of whale behavior and presence, available technology to avoid interactions, speed reduction measures, crew training, vessel-specific characteristics, modifications to vessel design and operation, sea conditions, and the effectiveness of various preventative measures. Beginning July 1, 2028, these policies must be submitted to the department or the Port Authority of New York and New Jersey at least 48 hours before entering the marine and coastal district, though not more often than annually. The department will review these policies for compliance and provide a 60-day period to amend any non-compliant policies. Failure to submit a compliant policy after notification will result in penalties, with fines ranging from $1,000 to $10,000 for each new violation and up to $15,000 per day for ongoing violations. The bill also clarifies that it does not authorize vessels to exceed existing speed restrictions or other applicable laws.
