This bill expands the use of body scanners, which are devices that use radiation to screen individuals, to facilities operated by the Office of Mental Health (OMH) and the Office for People with Developmental Disabilities (OPDD). These agencies will be required to create regulations for when body scanners will be used to screen visitors, clients, and employees in their state-operated residential and other facilities, similar to how they are used in correctional facilities. Importantly, the bill mandates that alternative screening methods must be available for individuals who decline or cannot use body scanners for medical reasons or for other reasons, unless security concerns prevent it, and ensures no one will face harassment or disciplinary action for choosing an alternative screening method. The bill also requires that personnel operating these scanners receive proper training and that the scanners themselves are registered with the relevant state agencies. Finally, OMH and OPDD will need to submit annual reports detailing the use of body scanners in their facilities.
