Additionally, the bill protects employees who choose to wear their own personal protective equipment that provides more protection than what the employer provides. If an employer takes negative action against an employee within 90 days of the employee engaging in these protected activities, there is a legal presumption that the employer violated the law, though the employer can rebut this presumption with clear and convincing evidence that their action was legally authorized. The bill aims to enhance worker safety and encourage open communication about potential health risks in the workplace.
