This bill provides a special provision for Janice Middlebrooks, the widow of William James Middlebrooks, who was employed at the Albion Correctional Facility and was a member of the New York State and Local Employees' Retirement System (NYSLERS). The bill allows Janice to file a retirement option election form on behalf of her deceased husband, who was diagnosed with cancer in January 2004, advised he could not return to work in October 2004, and passed away in December 2006 before filing his retirement paperwork. Specifically, the bill authorizes Janice to submit a request to the state comptroller for a joint allowance full option retirement benefit on or before December 31, 2025. Additionally, William's application for disability retirement will be retroactively deemed effective as of November 1, 2004. The bill will result in an immediate past service cost of approximately $472,000, which will be shared by the State of New York and local participating employers in NYSLERS. The retirement benefits will be paid to Janice and will be in addition to any other death benefits she may receive.
