This bill prohibits the sale of medical adhesives and bandages containing perfluoroalkyl and polyfluoroalkyl substances (PFAS), which are a class of fluorinated organic chemicals. Starting December 31, 2026, no person can sell medical adhesives and bandages that contain PFAS either as intentionally added chemicals or at levels above a threshold to be established by the state department. The bill defines medical adhesives and bandages as products intended for medical purposes that cover wounds, hold skin edges together, support injured body parts, or secure objects to the skin. Sellers can avoid violation if they have a written certificate of compliance from the manufacturer confirming the product meets PFAS restrictions. Manufacturers who provide false certificates of compliance will be in violation. Penalties for non-compliance include civil fines of up to $1,000 per day for a first violation, and up to $2,500 per day for subsequent violations. The bill excludes medical devices under exclusive FDA jurisdiction and provides a mechanism for the department to review and potentially lower PFAS levels every five years. The act takes effect immediately, with provisions for developing necessary implementation rules and regulations.
