This bill authorizes the Town of Brookhaven in Suffolk County to lease a small portion (approximately 0.0573 acres) of the Rolling Oaks Golf Course parkland to LI Smart Solutions LLC for the installation and operation of a wireless communication tower for a period not exceeding 30 years. The bill also grants an accompanying 15-foot-wide easement for access and utilities along the existing roadway. Any proceeds from the lease must be used for capital improvements to existing park and recreational facilities or for acquiring additional park lands. If the leased land stops being used for the specified wireless communication purposes, the lease will terminate, and the land will revert back to the town for public park use, with the wireless tower being removed. Additionally, if the parkland was originally purchased with federal funding, the town must comply with federal requirements and ensure that any land conversion meets the Secretary of the Interior's standards for equivalent land value and usefulness. The act would take effect immediately upon passage.
